The Office of Land and Streams is responsible for the Division of Natural Resources’ real estate and is charged with the maintenance, preservation and custody of the records relating thereto.  The Office of Land and Streams administers the acquisition and leasing of the Division of Natural Resources’ real estate and the permitting of the State of West Virginia’s rivers and streams.

Right-of-Entry Information

A project involving activity in a river or stream requires a Right-of-Entry issued by the Office of Land and Streams. 

To obtain a Right-of-Entry, an applicant must complete the Division of Natural Resources Stream Activity Application and send the application to the Office of Land and Streams either electronically or by mail.  The application must include a map highlighting the work area.

If a project involves more than one stream, then the OLS Application Table must be included with the application and map. 

No Right-of-Entry Needed

A Right of Entry is not required if an in-stream project involves removal of floating debris from the stream (i.e. tree limbs, trash blocking the mouth of a culvert or accumulating around the piers of a bridge) when the work is performed by hand or by using hand tools, such as a chainsaw or a shovel.

Transfer of Right-of-Entry

To transfer a Right of Entry, an applicant must complete the Transfer of Assets Form and the Affidavit of Transfers Form, and send the forms along with the appropriate documentation to the Office of Land and Streams either electronically or by mail.

Cancellation of Right-of-Entry

To cancel a Right of Entry, an applicant must complete the Cancellation of Permit Form, and send the form along with the appropriate documentation to the Office of Land and Streams either electronically or by mail.
